1. Acceptance of Terms

By accessing or using Sal's Variety Show / AI Multiverse Live ("the Show," "we," "us," or "our"), you ("user," "fan," or "creator") agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms in full, you must not access or use the platform. We may modify these Terms at any time; continued use after changes are posted constitutes acceptance of the revised Terms.

2. Age Eligibility

You must be at least 18 years old to participate in, submit content to, or otherwise use Sal's Variety Show / AI Multiverse Live, including making Submissions, purchasing memberships, or making donations. By using the platform, you represent and warrant that you are 18 years of age or older. We reserve the right to deny or revoke access to anyone who does not meet this requirement.

3. Fan Submissions & License Grant

By submitting content, images, video links, comments, or requests to be cast into the AI multiverse ("Submissions"), you grant the Show a perpetual, irrevocable, non-exclusive, sublicensable, worldwide, royalty-free license to use, reproduce, edit, remix, adapt, create derivative works from, and broadcast your Submissions and any resulting AI-generated content across TikTok, this platform, and any other promotional or commercial channel, in any format now known or later developed. You waive any right to inspect or approve the final AI-generated output before publication.

4. Creator Responsibility for Third-Party Content

If you submit, reference, upload, or direct the Show to use any third-party content — including but not limited to another person's likeness, image, video, audio, trademark, copyrighted material, or personal data — you represent and warrant that you own all necessary rights or have obtained all necessary permissions, licenses, and consents to submit that content and to grant the license in Section 2.

You are solely and entirely responsible for any Submission made without proper authorization. The Show has no obligation to verify ownership or permissions and disclaims all responsibility for unauthorized third-party content submitted by users. You agree to defend, indemnify, and hold harmless the Show, its owners, operators, affiliates, employees, and contractors from any claim, demand, loss, liability, damage, or expense (including reasonable attorneys' fees) arising out of or related to your Submission of unauthorized third-party content, including claims of copyright infringement, right-of-publicity violations, defamation, or invasion of privacy.

5. Payments & Tiers

Superfan tier memberships and one-time donations are processed securely through Base44 Payments. All purchases are final and non-refundable except where required by applicable law. Custom video orders are priced per the duration selected at checkout and are subject to production availability; the Show does not guarantee delivery timelines or specific creative outcomes.

6. Content & Conduct

Submitted content must not contain hateful, illegal, defamatory, obscene, or infringing material, nor depict any real person without that person's consent. The Show reserves the right to deny, remove, edit, or decline to use any Submission at its sole discretion, for any reason or no reason, without notice or liability.

7. Assumption of Risk

You acknowledge that participating in the Show — including submitting content, appearing in AI-generated scenes, and having your handle or likeness published publicly on TikTok and other channels — carries inherent risks, including public exposure, unpredictable AI outputs, and reactions from other users or the public. You voluntarily assume all such risks by using the platform.

8. No Guaranteed Outcomes

The Show makes no guarantee regarding views, engagement, virality, follower growth, or any other business, promotional, or personal outcome resulting from your Submission, membership, or custom video order. Any examples of past performance are illustrative only and not a promise of similar results.

9. Disclaimer of Warranties

The platform, the Show, and all AI-generated content are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. AI-generated content is produced for entertainment purposes only and may include stylized, fictionalized, exaggerated, inaccurate, or unpredictable depictions of fans, creators, and their likenesses. We do not guarantee that the platform will be uninterrupted, secure, or error-free.

10. Limitation of Liability — Zero Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SHOW, ITS OWNERS, OPERATORS, AFFILIATES, EMPLOYEES, AND CONTRACTORS SHALL HAVE NO LIABILITY WHATSOEVER FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM, ANY SUBMISSION, ANY AI-GENERATED CONTENT, ANY THIRD-PARTY CONTENT, ANY PAYMENT OR MEMBERSHIP, OR ANY OTHER INTERACTION WITH THE SHOW — INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REPUTATION, EMOTIONAL DISTRESS, LOST PROFITS, OR THIRD-PARTY CLAIMS — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ALL CASES, THE SHOW'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO THE SHOW, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR TEN U.S. DOLLARS ($10), WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIABILITY LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify, defend, and hold harmless the Show and its owners, operators, affiliates, employees, and contractors from any and all claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the platform, your Submissions, your violation of these Terms, or your violation of any rights of a third party.

12. Copyright Complaints (DMCA)

If you believe a Submission or any content on the platform infringes your copyright, send a written notice via our Contact page including: a description of the copyrighted work, the location of the allegedly infringing content, your contact information, and a statement made in good faith that the use is unauthorized. We will review valid notices and may remove or disable access to the reported content and, in appropriate cases, terminate access for repeat infringers.

13. Termination

We may suspend or terminate your access to the platform at any time, without notice or liability, for any reason, including violation of these Terms.

14. Force Majeure

The Show shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, internet or platform outages (including TikTok), or governmental action.

15. Dispute Resolution — Arbitration & Class Action Waiver

You and the Show agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the platform shall be resolved by binding individual arbitration, rather than in court, except that either party may bring an individual action in small claims court. You and the Show each waive any right to a jury trial and any right to participate in a class action, class arbitration, or representative action.

16. Governing Law

These Terms are governed by the laws of the jurisdiction in which the Show operates, without regard to conflict-of-law principles. Subject to Section 15, any disputes not subject to arbitration shall be resolved exclusively in the courts of that jurisdiction.

17. Severability & Entire Agreement

If any provision of these Terms is found unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Show regarding your use of the platform, superseding any prior agreements. Our failure to enforce any provision shall not be deemed a waiver of that provision.
